Terms and Conditions

Welcome to the task management platform located at IvarsSvarcs.com (hereinafter referred to as "the Platform").

The Platform, along with its integrated transaction verification infrastructure, is entirely developed, owned, and operated by Ivars Švarcs (hereinafter referred to as "the Operator").

These Terms and Conditions ("Terms") govern your access to and use of the Platform's website and services. By registering an account or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Purpose of the Platform and Audience

  • Services: The Platform provides task management, project coordination, and related computer programming/development support features.
  • Target Audience: The Platform is primarily designed for business clients (B2B). However, availability is not restricted solely to legal entities. Anyone who registers must comply with these Terms.

2. Account Registration, Security and Operational Data

  • Accuracy: Users must provide a valid email address during registration.
  • Account Safety: You are entirely responsible for maintaining the confidentiality of your login credentials (password) and for all actions that occur under your account.
  • Client's Security Obligation: It is strictly the client’s sole obligation to manage, transmit, and operate all data necessary for task completion (including, but not limited to, source code, production environment access credentials, API tokens, or server passwords) in a secure manner.
  • Unauthorized Use: You must immediately notify the Platform if you suspect any unauthorized access or breach of security.

3. Wallet Top-Up and Payments

  • Third-Party Processing: Wallet top-ups are processed entirely through independent, external Payment Providers. To complete a payment, you will be redirected to the Payment Provider's secure website, where you must sign in with your own credentials.
  • Data Isolation: The Platform does not have access to, nor does it maintain any knowledge of, your personal account details or financial credentials held by the Payment Provider.
  • Proprietary Verification: For technical security, payment completion data is routed through our proprietary secondary infrastructure domain ("SvarcsPay.com"). This domain is fully owned and operated by the Operator. It utilizes encoded metadata to recognize and credit your Platform wallet.
  • Payment Disputes: Since financial transactions occur strictly within the external Payment Provider's ecosystem, the Platform is not responsible for payment failures, bank declines, or unauthorized third-party charges. Any disputes regarding the transfer of funds must be addressed directly with your Payment Provider.

4. Acceptable Use Policy

Users agree not to use the Platform to:

  • Violate any applicable local, national, or international laws or regulations.
  • Upload, store, or transmit any malicious code, viruses, or destructive data.
  • Interfere with or disrupt the integrity, security, or performance of the Platform.
  • Attempt to gain unauthorized access to other users' accounts or server infrastructure.

5. User-Generated Content and Intellectual Property

  • Ownership: You retain all intellectual property rights over the data, tasks, projects, and text you upload to the Platform. The Platform claims no ownership over your content.
  • Platform Property: The Platform’s design, code, architecture, graphics, branding, and core software are the exclusive intellectual property of the Operator. You may not copy, modify, or reverse-engineer any part of the Platform or its payment processor domain.

6. Action Transparency and System Logging

  • Auditing: The Platform automatically logs user activities (such as logins, task modifications, wallet top-ups, and deletion events) along with your IP address.
  • Dispute Resolution: These system logs may be used as an important technical record when investigating operational issues, security incidents, or disputes.

7. Limitation of Liability and "As-Is" Provision

  • Service Availability: The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. While the developer strives to maintain high uptime and fix bugs promptly, the Platform makes no warranties that the service will be entirely uninterrupted or error-free.
  • Limitation: To the maximum extent permitted by law, the Platform and its Operator shall not be liable for any direct, indirect, incidental, or consequential damages, including but not limited to loss of business, profits, or data, arising from the use or inability to use the Platform.
  • Infrastructure Exclusion: The Platform utilizes external cloud hosting infrastructure and cannot be held liable for hardware failures or data center disruptions originating at the third-party infrastructure level.

8. Termination of Service

  • By Platform: The Platform reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activities, or disrupt server infrastructure, without prior notice.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Latvia / the European Union. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Latvia.
